Cancellation

In the event of illness or other emergency, please call or email as soon as possible to reschedule. Enfys Photography maintains the right to reschedule if needed due to inclement weather, illness, emergency, etc. Requests for rescheduling or re-shoots are granted only at the Photographer's discretion. This decision must be made before the session begins or within the first 20 minutes of the session (45 minutes for newborn sessions).If it is determined by the Photographer that your session needs to be rescheduled within the first 20 minutes (45 minutes for newborn sessions), the photographer will reschedule your session at no charge. However, if your session needs to be rescheduled after 20 minutes (45 minutes for newborn sessions), a small fee will apply to reschedule. Any sessions exceeding the specified timeframe (timeframes will vary according to session type) will include an additional fee of $50/hour. This includes sessions that have been rescheduled after the first 20 minutes (45 minutes for newborn sessions). The specified timeframe of each session includes any time spent on the original session date as well as any hours spent on the rescheduled date. Rescheduling your session is left to the discretion of the Photographer. 

Liability

Although the utmost care will be taken, if the Photographer cannot fulfill this contract due to fire or other casualty, strike, natural or other cause beyond the control of the parties, or due to the Photographer's illness or emergency, then the Photographer shall return any deposit or session fee to the Client, but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client's order. The Client releases Audrey Cooper of Enfys Photography from all liabilities, claims, damages, or injuries that may result from any accidents or incidents that may happen during the session in studio or on location. The Client releases the owner of any private land used on location from all liabilities, claims, damages, or injuries that may result from any accidents or incidents that may occur on private property.

 

 

Deposit & Payment

A non-refundable $50 deposit is due upon booking. Session fees cover time and talent of the Photographer and secure your session date and current pricing and package. Prints and other products are sold separately. 

Product orders are due when the item(s) have been ordered. 

Modifications

If the Client has a request for a small alteration of an image, please let the photographer know when you place your order. The Photographer can address minor changes at no cost (fix blemishes, tighter crop, etc.), but more involved requests are billed at $25/hour. The photographer will let you know if there will be extra charges before work begins. Once requested changes are made, charges apply regardless of whether the final product is purchased.

Digital Images

Enfys Photography will provide a photo print release for all non-watermarked, high resolution digital images which client has selected as part of their package. Do not alter the images before printing (except to crop picture to product size). The Photographer is not responsible for printing errors or for quality of prints or products printed elsewhere.
The watermark on the low resolution images (provided at no additional cost) may be shared with friends and family or on social media, but the watermark cannot be removed. 

Copyright & Model Release

The Copyright Law of Canada assigns the copyright of the images to the Photographer (Audrey Cooper of Enfys Photography), and all images shall remain the sole property of Photographer. The Photographer retains for life, the right to display any photograph covered by this Contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums and prints, venue and other vendor samples, and other such material, providing that the images used are used lawfully and without damage to the Client. The Photographer hereby grants to the Client, a limited, non-exclusive, non-transferable, royalty-free license to reproduce, display and/or distribute the images, provided the Client complies with the condition that all such reproductions and/or displays are not intended for a commercial venture.
